These Terms of Service (“Terms”) constitute a legal agreement between you (“User”, “You”) and the KitchenOwl development team (“we”, “us”, “our”) regarding your use of the KitchenOwl application and related services (“Service”, “App”).
1. Acceptance of Terms
By downloading, installing, accessing, or using KitchenOwl, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service. You represent that you are of legal age to form a binding contract and are not prohibited from receiving services under applicable law.
2. Description of Service
KitchenOwl is a free, open-source application for grocery list management, recipe organization, meal planning, and household expense tracking. The Service includes native applications for Android, iOS, Web, and Desktop platforms, as well as self-hosting capabilities.
3. User Generated Content
3.1 Your Responsibility
You are solely responsible for all content you create, upload, share, or store through the Service, including but not limited to recipes, shopping lists, meal plans, expense records, and any other data (“User Content”). KitchenOwl is not responsible for any User Generated Content.
3.2 Content Guidelines
You agree not to use the Service to create, upload, or share content that:
- Violates any applicable laws or regulations
- Infringes upon intellectual property rights of third parties
- Contains harmful, offensive, defamatory, or inappropriate material
- Includes personal information of others without consent
- Contains viruses, malware, or other harmful code
3.3 Content Monitoring
We reserve the right, but have no obligation, to monitor, review, or remove User Content that violates these Terms or is otherwise objectionable. We do not endorse any User Content and expressly disclaim any liability related to User Content.
4. Intellectual Property Rights
4.1 KitchenOwl Content
The KitchenOwl application, including its source code, design, features, and documentation, is protected by intellectual property laws. The application is made available under open-source licenses, and you may use, modify, and distribute the software in accordance with the applicable open-source license terms.
4.2 User Content License
By creating User Content through the Service, you retain ownership of your content but grant us a non-exclusive, royalty-free license to store, process, and display your content solely for the purpose of providing the Service to you.
5. Privacy and Data Protection
Your privacy is important to us. Our handling of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. For self-hosted installations, you maintain full control over your data.
6. Disclaimers and Limitation of Liability
6.1 Service Disclaimer
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND. We disclaim all warranties, whether express or implied, including but not limited to:
- Warranties of merchantability and fitness for a particular purpose
- Warranties that the Service will be uninterrupted or error-free
- Warranties regarding the accuracy or reliability of content
6.2 Content Disclaimer
KitchenOwl is not responsible for the accuracy, completeness, or reliability of any User Generated Content, including recipes, nutritional information, or expense data. Any reliance on such content is at your own risk.
6.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION.
7. User Responsibilities
7.1 Account Security
You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.
7.2 Compliance
You agree to use the Service in compliance with all applicable laws and regulations and in accordance with these Terms.
7.3 Self-Hosting
If you choose to self-host KitchenOwl, you are solely responsible for the installation, maintenance, security, and operation of your instance.
8. Prohibited Uses
You may not use the Service to:
- Engage in any illegal activities
- Violate the rights of others
- Distribute spam or unsolicited communications
- Attempt to gain unauthorized access to our systems
- Interfere with the proper functioning of the Service
9. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason. You may discontinue use of the Service at any time.
10. Open Source Considerations
KitchenOwl is open-source software. The source code is available under applicable open-source licenses, which may grant you additional rights beyond these Terms. In case of conflict between these Terms and the open-source license, the open-source license shall prevail with respect to the source code.

The Service may integrate with or link to third-party services or websites. We are not responsible for the content, policies, or practices of third-party services.

We reserve the right to modify these Terms at any time. We will notify users of material changes through the Service or other reasonable means. Continued use of the Service after changes constitutes acceptance of the modified Terms.

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to conflict of law principles.
